Do I need a lawyer to help me with my injury claim?
Not every case requires the assistance of a qualified legal professional. It generally comes down to the severity of your injuries and/or if there is an issue with regard to who is at fault.
For some people, affordability may be a concern.
The decision whether or not to hire a lawyer can be confusing because every situation is different, so here are a few things for you to consider:
How complicated is my claim?
If you were involved in a minor accident and your injuries are mild enough to heal in a few days or weeks, your claim may fall within the Minor Injury Regulation in Alberta which will limit the amount of your compensation, in which case a lawyer may not be required.
Since the effect of some injuries is not completely realized until several months or even up to a year after an accident occurs, we caution against settling with your insurance company too early if there is any uncertainly about the severity of your injury, how it may progress or escalate, or how long the effects may linger.
You should certainly delay settling your claim until all of your injury symptoms are fully resolved because once your claim is settled, you won’t be entitled to make a further claim - even if you have persisting issues. If your accident was serious/severe and you expect your recovery to take more than six months, you should consider hiring a competent, experienced lawyer who will protect your interests, guide you through the claims process, and help you maximize your compensation. The sooner you make this decision, the easier it will be to gather the appropriate evidence to support your claim.
If you have been involved in a serious accident and sustained moderate to severe injuries (e.g. broken bones, concussion, severe whiplash), or if you are likely to miss a significant amount of time away from work, or your ability to perform routine household activities is compromised, then it’s advisable to have the representation of a legal professional who will assist you, ensure compliance with the technical requirements of a more significant claim, and advocate for the settlement you deserve.
If there is an issue with who is at fault, you are best served to retain the services of a lawyer.
